The options available to people and companies to publicise their name and brand is now almost infinite. Whilst still important television or press advertising is just a small part of this. For companies sponsoring television shows and public events is increasingly popular, not only for major worldwide events but also region specific occasions. Advertising has a number of formats that are being increasingly considered, such as emails and internet advertising or product placement in films. A cross over occurs with high profile individuals as both the person and the company realise that matching their values as part of an advertising campaign or product endorsement can be of enormous benefit to both. Celebrities are also realising that their own brand products or products that they endorse can be successful commercial opportunities in their own right.

There is a great deal that you need to be aware of when planning any form of promotional work. You need to be sure that you own appropriate rights in the finished product, that you are not infringing any other person's rights in the campaign (for example if it is a parody of a well known film) and that the campaign does not breach any of the Advertising Standards Authority’s Code. Additionally, whether you are the company or the personality it is crucial that you are protected in case there is any divergence in either's interest.

We have advised on and drafted agreements in all aspects of promotional work. We have acted for companies and advertising agencies in advising on whether campaigns can be run and represented companies and individuals in negotiating product endorsements so know what is required.

There are also times when companies try to use a celebrity's image without permission and often to the detriment of that celebrity’s public image. We have acted for the personality in that situation to obtain redress for such action.

Atkins represented Josh Hartnett in his successful libel claim against the Daily Mirror. The newspaper has paid substantial damages, which Mr Hartnett is donating to charity, and apologised in Court, where Graham spoke on behalf of Mr Hartnett. Full wording of the court statement can be seen here.

Atkins represents the family of murdered BBC journalist Kate Peyton at an inquest in Ipswich set up to establish the circumstances that led to her tragic death.
