This is an increasingly high profile area of law because of the way that the newspapers and magazines are increasingly searching for more salacious information about personalities or celebrities. We have often acted for members of the public who, through no fault of their own, have become embroiled in stories that should remain private.
There is also a proliferation of magazines that trade in photographs of celebrities or those in the public eye, and quite often use photographs of their children which ought to remain private. It is often crucial to protect your privacy. Many high profile individuals have become unstuck as a result of either allowing or ignoring personal stories or photographs that have been published. As a result when a further story is published that misuses private information they have a lot of trouble dealing with it. Confidential relationships are often reinforced by the use of confidentiality agreements, these also have the advantage of demonstrating that the parties to that relationship realise that a duty of confidentiality is owed even if the law has not established that previously.
